成立声明(Founding Statement)
一、组织宗旨(Our Purpose)
“移民公平法律行动组”(Migrant Fairness Legal Action Group, MFLAG)由居住在英国、依法在英工作与生活的移民群体共同发起,旨在捍卫移民群体在英国法律框架下应有的合法权益,反对任何形式的追溯性不利政策,维护英国长期秉持的法治、公平与行政正当原则。
我们相信,一个真正公平、文明、稳定的社会,必须建立在规则一致性与政府承诺可靠性的基础上。
二、成立背景(Background)
针对英国政府正在推进的 《通往更公平永居的道路》(Towards a Fairer Path to Settlement) 政策改革,我们注意到:
政府拟将现行 工作签证5年可申请永居 的制度延长至 10年,并可能适用于已经在英、已经按既有规则规划人生和家庭路径的申请者。
如果该政策以“一刀切”和“追溯适用”的方式实施,将会:
破坏申请人基于政府既定政策作出的合理预期(Legitimate Expectation)
违反英国法律一贯坚持的**不利政策不可追溯(No Retrospective Disadvantage)**原则
给数十万守法工作移民及其家庭带来严重、难以逆转的经济与生活损害
破坏英国作为全球人才目的地的信誉与国际形象
因此,本组织基于责任、良知与法治信念成立。
三、我们的立场(Our Position)
我们强调:
我们不反对英国政府对未来移民政策进行改革。
但我们坚决反对政府将新的、不利的永居规则套用在已经在英并按旧政策规划人生的群体身上。
我们捍卫的不是优惠,是公平;
我们争取的不是特权,而是英国法律本应保障的程序正义。
四、我们的行动(Our Actions)
为保障移民群体的权利,本组织将开展以下正式行动:
1. 向政府部门递交联合法律意见书与政策反馈
包括内政部、移民事务委员会、相关议会委员会等。
2. 与跨党派议员建立沟通机制
推动国会关注并审查追溯性政策的合法性与合理性。
3. 开展全社区证据与受害人影响收集
形成正式的“政策影响评估报告”。
4. 必要时启动司法复核(Judicial Review)程序
一旦政府坚持对现有申请人追溯适用,本组织将立即启动:
律师团队介入
出具正式的 Pre-Action Protocol Letter(PAP)
向高等法院申请司法复核
以维护移民群体的合法权利。

Founding Statement
I. Our Purpose
The Migrant Fairness Legal Action Group (MFLAG) is founded by migrants who lawfully live and work in the United Kingdom. Our mission is to safeguard the legitimate rights afforded to migrant communities under the UK legal framework, to oppose any form of retroactive disadvantage in policymaking, and to uphold the long-standing principles of the rule of law, fairness, and proper administration in the United Kingdom.
We firmly believe that a truly fair, civilised, and stable society must be built upon consistent rules and a government whose commitments can be relied upon.
II. Background
In response to the UK Government’s proposed reform titled “Towards a Fairer Path to Settlement”, we note with deep concern that:
The Government intends to extend the current 5-year route to settlement for skilled workers to 10 years, and may apply this change to individuals who are already in the UK and who have made life, family, and career plans based on the existing rules.
If implemented in a blanket, retroactive manner, such a policy would:
Undermine applicants’ Legitimate Expectation created by the current immigration rules
Contradict the UK’s long-established principle of No Retrospective Disadvantage
Inflict serious and irreversible economic and personal harm on hundreds of thousands of law-abiding migrant workers and their families
Damage the UK’s reputation and credibility as a global destination for talent
This organisation is therefore established out of responsibility, conscience, and a commitment to the rule of law.
III. Our Position
We emphasise the following:
We do not oppose the Government’s right to reform immigration policy for future applicants.
However, we firmly oppose the application of new and disadvantageous settlement rules to those who are already in the UK and have relied on the existing 5-year scheme in planning their futures.
What we seek is not privilege, but fairness.
What we defend is not special treatment, but the procedural justice guaranteed under UK law.
IV. Our Actions
To safeguard the rights of the migrant community, MFLAG will undertake the following formal actions:
1. Submission of Joint Legal Opinions and Policy Responses
Directed to the Home Office, the Migration Advisory Committee, and relevant parliamentary committees.
2. Establishing Cross-Party Parliamentary Engagement
To encourage parliamentary scrutiny regarding the legality and reasonableness of retrospective policy changes.
3. Community-Wide Evidence and Impact Collection
To produce an official “Policy Impact Assessment Report”.
4. Initiating Judicial Review Where Necessary
If the Government insists on applying the new rules retroactively, we will immediately proceed with:
Engagement of legal counsel
Issuance of a Pre-Action Protocol Letter (PAP)
Filing for Judicial Review before the High Court
We will take all lawful steps to protect the rights of affected migrants.
